Associate Justice Amy Lazaro-Javier of the Supreme Court recently pointed out that the Philippine Health Insurance Corp. (PhilHealth) has been prioritizing investments over program benefits and lower member contributions. This observation came during the oral arguments regarding the controversial transfer of P89.9 billion in excess funds from PhilHealth to the national treasury.


Justice Lazaro-Javier emphasized that PhilHealth's actions do not align with Section 11 of the Universal Health Care (UHC) Act, which mandates that any excess reserve funds should be used to enhance benefits or reduce member contributions. Instead, PhilHealth has been investing these funds, which has raised concerns about compliance with the law.
